1 Ambito di applicazione / modifica delle condizioni generali

Le seguenti Condizioni Generali di Contratto (“CG”) si applicano a tutte le transazioni commerciali presenti e future, ai contratti e alle relazioni commerciali effettuate su https://www.michaelmortini.com.

Le presenti Condizioni Generali si applicano sia ai consumatori che agli imprenditori ai sensi  del Codice del Consumo italiano (Dlgs. 06/09/2005, n. 206).

Per la legge italiana, il Consumatore è definito come qualsiasi persona fisica che agisce per fini che non rientrano nella sua attività commerciale, imprenditoriale, artigianale o professionale.

Creando l’apposito account sul sito, l’Utente accetta le presenti Condizioni Generali e dichiara di essere d’accordo con il loro contenuto. Le CG possono essere richiamate, scaricate, stampate e memorizzate.

Questa piattaforma rifiuta espressamente le condizioni generali di contratto dell’Utente.

Condizioni generali di contratto divergenti o complementari dell’Utente non diventeranno parte del contratto, anche se non sono state espressamente rifiutate.

Le disposizioni delle presenti CG possono essere modificate da www.michaelmortini.com in qualsiasi momento senza indicarne i motivi. L’Utente deve verificare le modifiche apportate alle CG prima di accedere alla piattaforma.

L’Utente accetta le CG modificate tramite il “log in” sulla piattaforma.

2 Conclusione di un contratto

Ogni volta che viene menzionato www.michaelmortini.com o “questo sito” o “questa piattaforma” ci si riferisce a Pretotto Beatrice.

M. Mortini è il creatore del software concesso in licenza all’Utente su questo sito. Ogni limitazione di responsabilità prevista da queste CG sono estese a M. Mortini.

www.michaelmortini.com offre prodotti e accesso alla piattaforma solo a persone maggiorenni. L’Utente dichiara di avere almeno 18 anni.

3 Registrazione / Dati di accesso

Per poter utilizzare i servizi forniti da www.michaelmortini.com su questo sito, l’Utente si impegna a registrarsi sulla piattaforma fornendo a quest’ultima informazioni valide e veritiere in conformità con il modulo di registrazione. L’Utente potrà usufruire dei servizi forniti sulla piattaforma solo dopo aver completato con successo la registrazione.

Questa piattaforma ha il diritto di rifiutare gli utenti a sua discrezione, senza indicarne i motivi e di modificare uno qualsiasi dei criteri di iscrizione in qualsiasi momento prima di concludere una transazione.

4 Disclaimer: limitazione di responsabilità

Questo sito offre all’Utente la possibilità di acquistare un robot di trading divulga informazioni con finalità esclusivamente didattiche. NON devono essere intesi in alcun modo come consiglio operativo di investimento né come sollecitazione alla raccolta di pubblico risparmio.

Il robot di trading è un programma software automatizzato che aiuta i trader a determinare se acquistare o vendere una coppia di valute nel mercato forex o altri asset nel mercato in CFD in un dato momento.

L’Utente comprende e riconosce espressamente i rischi legati al Live Trading.

L’Utente è l’unico responsabile nel provvedere alle rispettive impostazioni e/o livelli di verifica necessari o utili per l’utilizzo del bot. Inoltre, questa piattaforma non si assume alcuna responsabilità per qualsiasi connessione internet con il server del Broker, in particolare, ma non solo, per quanto riguarda la larghezza di banda, il tempo di ping, o qualsiasi altro dettaglio di qualsiasi connessione internet.

Il software è fornito dal Venditore e accettato dal Licenziatario “così com’è”. La responsabilità del Venditore sarà limitata ad un massimo del prezzo di acquisto originale del software. Il Venditore non sarà responsabile di alcun danno generale, speciale, incidentale o consequenziale incluso, ma non limitato, a perdita di produzione, perdita di profitti, perdita di entrate, perdita di dati o qualsiasi altro affare o svantaggio economico subito dal Licenziatario derivante dall’uso o dal mancato uso del software.

Il Venditore non garantisce che l’uso del software sia ininterrotto o privo di errori. Il Licenziatario accetta che il software in generale sia soggetto a bug e difetti entro un livello accettabile come determinato nell’industria. Il Venditore può sospendere il funzionamento delle licenze, in tutto o in parte anche senza preavviso, in caso di guasti alla rete e agli apparati che dipendano da cause di forza maggiore, ovvero da eventi al fuori del controllo di michaelmortini.com.

Se l’Utente è un Consumatore, si prega di notare che in alcune giurisdizioni le leggi a tutela dei consumatori potrebbero non consentire alcune esclusioni o limitazioni di garanzie o responsabilità e di conseguenza alcune delle suddette esclusioni e limitazioni potrebbero non essere applicabili.

5 Licenze – copyright – clausola di risoluzione espressa

Questa piattaforma in accordo con il creatore del software si impegna a concedere all’Utente una licenza non esclusiva per utilizzare il software disponibile sulla piattaforma. Questa piattaforma si riserva il diritto di escludere l’Utente se questo ha violato uno dei suoi obblighi ai sensi delle presenti CG o se l’Utente ha violato qualsiasi legge in relazione al funzionamento del bot.

Per “software” si intende il programma per computer eseguibile e tutta la relativa documentazione stampata, elettronica e online e qualsiasi altro file che può accompagnare il prodotto.

Il titolo, il copyright, i diritti di proprietà intellettuale e i diritti di distribuzione del software rimangono esclusivamente al Venditore. I diritti di proprietà intellettuale includono l’aspetto del software. Il presente Contratto costituisce una licenza d’uso e non costituisce in alcun modo un trasferimento dei diritti di proprietà del software.

Il software non può essere caricato o utilizzato su un conto di trading diverso da quello associato alla licenza del software al momento dell’acquisto. La strategia del software non può essere replicata su conti di trading per cui non si è acquistata una specifica licenza.

I diritti e gli obblighi del presente Accordo sono diritti personali concessi solo al Licenziatario. Il Licenziatario non può trasferire o assegnare nessuno dei diritti o degli obblighi concessi dal presente Contratto a qualsiasi altra persona o entità legale. Il Licenziatario non può rendere disponibile il software per l’uso da parte di uno o più terzi, se non espressamente indicato, richiesto e concordato al momento dell’acquisto su questa piattaforma. In tal caso, l’Utente che acquista la licenza si farà carico di ogni eventuale responsabilità nei confronti di terzi beneficiari. 

Il software non può essere modificato, reingegnerizzato o de-compilato in nessun modo attraverso le tecnologie disponibili attuali o future.

Il funzionamento della licenza è subordinato al rimanere in essere di questa piattaforma.

Il mancato rispetto di uno qualsiasi dei termini di questa sezione causerà la risoluzione immediata del presente accordo.

6 Risoluzione e rimborso dei pagamenti

Se www.michaelmortini.com dovesse risolvere la licenza a causa di una violazione commessa dall’Utente non ci sarà alcun rimborso.

7 Diritto di ripensamento

Ai sensi dell’art. 52 del Codice del Consumo italiano, il Diritto di Recesso si applica a qualsiasi acquisto di software digitale che richiede un download e che non è stato utilizzato.

Al momento dell’acquisto, riconoscete che il vostro diritto di recesso è rinunciato quando scaricate o ricevete in qualsiasi forma o mezzo il software digitale.

Per esercitare il diritto di recesso, l’Utente deve inviare alla piattaforma una dichiarazione inequivocabile della sua intenzione di recedere dal contratto entro 14 giorni dall’acquisto.

L’Utente è comunque libero di esprimere la sua intenzione di recedere dal contratto facendo una dichiarazione inequivocabile in qualsiasi altro modo adeguato (ad esempio una lettera inviata per posta).

Al fine di rispettare il termine entro il quale l’Utente può esercitare tale diritto, l’Utente deve inviare la comunicazione di recesso prima della scadenza del periodo di recesso.

L’Utente che recede correttamente dal contratto sarà rimborsato dalla piattaforma per tutti i pagamenti effettuati a www.michaelmortini.com.

8 Obblighi di cooperazione dell’Utente

L’Utente si impegna a fare tutto ciò che è in suo potere per assicurare la rapida esecuzione del contratto e ad astenersi dal fare tutto ciò che potrebbe ostacolare o compromettere l’esecuzione del contratto. L’Utente dovrà comunicare immediatamente a www.michaelmortini.com eventuali difetti o altri problemi relativi al prodotto acquistato.

9 Rischi

L’Utente comprende e accetta i rischi elencati di seguito in relazione all’uso della piattaforma e del software fornito con essa. Questi includono in particolare i seguenti rischi:

  1. Rischio del software: Il software concesso in licenza da michaelmortini.com è ancora in fase di sviluppo ed è soggetto a continui cambiamenti. Non si può escludere che il software non sia ancora completamente sviluppato e contenga punti deboli o errori che possono limitare il trading basato sui bot.
  2. Regolamenti: Finora, il software concesso in licenza da michaelmortini.com non è stato soggetto ad alcuna restrizione normativa significativa. Tuttavia, non si può escludere che il software concesso in licenza, in un futuro, potrebbe essere soggetto a restrizioni imposte dalla legge. In questo caso questa piattaforma non avrà alcuna responsabilità a causa dell’impatto della nuova regolamentazione.
  3. Pericoli e perdite su Internet: michaelmortini.com può diventare il bersaglio di attacchi fisici o elettronici. Tali eventi potrebbero causare la perdita di dati (come i dati personali o altri dati forniti o creati dall’Utente). I dati potrebbero anche essere sottratti illegalmente e utilizzati per scopi abusivi o fraudolenti (come il phishing o lo spoofing). L’Utente controllerà attentamente i messaggi e le comunicazioni provenienti da www.michaelmortini.com e verificherà se i messaggi o le comunicazioni provengono da www.michaelmortini.com.
  4. Nessuna garanzia di successo: L’uso del software concesso in licenza da michaelmortini.com non è una garanzia che l’Utente ne ricaverà un successo economico. Il software concesso in licenza da www.michaelmortini.com offre semplicemente all’Utente la possibilità di impostare un bot. www.michaelmortini.com NON offre in alcun modo servizi finanziari o di investimento. Le informazioni divulgate e il software non devono essere intesi in alcun modo come una consulenza operativa di investimento, né come una sollecitazione alla raccolta del pubblico risparmio o alla gestione del patrimonio. Il software in questione è uno strumento operativo destinato esclusivamente alla piattaforma di trading “Metatrader 4” per assistere l’Utente nel trading sul mercato Forex. L’Utente può attivare e disattivare le funzioni del software in qualsiasi momento, impostando ogni parametro secondo la propria strategia e mantenendo un controllo costante sulle attività di Trading svolte; l’Utente può infatti autorizzare o inibire l’apertura di nuove operazioni e chiudere in qualsiasi momento le operazioni aperte, mantenendo un controllo costante del proprio Conto Trading e l’ultima parola su tutte le decisioni. Il software deve essere inteso come uno strumento che attraverso determinati algoritmi permette all’Utente di sviluppare specifiche strategie di trading: l’Utente mantiene sempre il pieno controllo del proprio conto di trading, decidendo autonomamente gli asset con cui operare, la strategia da utilizzare, i metodi di entrata e uscita dal mercato e tutto ciò che riguarda la gestione del denaro e il profilo di rischio/rendimento. L’Utente si assume la piena e totale responsabilità delle proprie scelte e delle strategie operative applicate attraverso il software. L’Utente è pienamente consapevole dei rischi economici connessi a qualsiasi forma di utilizzo del software e in generale è consapevole che operare con denaro reale nel settore del trading comporta rischi molto elevati di perdita di quanto investito. Attivando manualmente il software, l’Utente accetta che esso automatizzi per suo conto alcuni processi operativi, sollevando totalmente michaelmortini.com da qualsiasi responsabilità relativa a danni o perdite subite. michaelmortini.com, in qualità di produttore e distributore del software, declina espressamente, per sé e per i suoi collaboratori, qualsiasi responsabilità derivante dall’uso dei suoi servizi, per qualsiasi perdita o danno subito dall’Utente. È obbligo dell’Utente impostare, controllare e monitorare costantemente il lavoro del software. L’Utente deve utilizzare strategie di Trading compatibili con i propri obiettivi e con la propria propensione al rischio; gli algoritmi implementati nel software non forniscono e non possono fornire alcuna garanzia in merito a eventi futuri e imprevedibili, come l’andamento dei mercati o le notizie macroeconomiche. La salvaguardia del capitale investito dipende esclusivamente dalle scelte dell’Utente, in particolare per quanto riguarda l’entità delle operazioni aperte e la gestione del denaro. Le diverse strategie illustrate nel manuale d’uso rappresentano solo un esame parziale a scopo didattico delle possibili modalità di utilizzo del software e non possono in alcun modo essere considerate una consulenza finanziaria o di investimento. L’attività di consulenza fornita da michaelmortini.com e dai suoi collaboratori è limitata a questioni tecniche, quali l’installazione e l’utilizzo delle varie funzioni del software; non può essere considerata un’attività di consulenza finanziaria, che è legalmente delegata a consulenti finanziari qualificati. I risultati mostrati relativi all’utilizzo del software (test, cronologie e risultati riportati sul sito web www.michaelmortini.com e forniti anche con altri mezzi) non costituiscono alcuna garanzia di ipotetiche e analoghe performance di profitto future. L’Utente è consapevole che il valore dei beni in valuta o di qualsiasi altro asset è soggetto ad un rischio generale di mercato e quindi a fluttuazioni di valore e di prezzo; michaelmortini.com non ha alcuna influenza sui valori e sui prezzi delle valute scambiate o di altri beni o attività.
  6. Tasse: L’utilizzo del bot e soprattutto le transazioni che ne derivano possono avere effetti fiscali a livello del cliente secondo la legge del Paese di quest’ultimo. L’Utente dichiara espressamente che chiarirà qualsiasi effetto fiscale e otterrà una consulenza appropriata (ad esempio da un consulente fiscale). L’Utente dichiara inoltre espressamente di non ritenere michaelmortini.com o qualsiasi parte associata ad esso (in particolare consulenti, dipendenti e altri partner contrattuali) responsabile degli obblighi fiscali.

10 Responsabilità

L’amministrazione della piattaforma viene effettuata da www.michaelmortini.com con la dovuta cura. L’Utente è consapevole del fatto che interruzioni, guasti o altri errori e problemi possono verificarsi sia nel software (vale a dire bug del software) e l’hardware dei servizi basati su Internet e tecnologia sperimentale. www.michaelmortini.com cercherà di trovare soluzioni a tali problemi, per quanto possibile. In ogni caso, www.michaelmortini.com non si assume alcun obbligo e in particolare alcuna responsabilità per i danni che possono derivare o verificarsi da interruzioni, guasti o altri errori e problemi di o in connessione con la piattaforma e i servizi offerti e / o il software, in particolare in caso di operazioni non previste o false operazioni, che possono portare ad un danno finanziario e / o altro di qualsiasi Utente.

Nella misura consentita dalla legge, www.michaelmortini.com sarà responsabile solo per qualsiasi motivo legale se il danno è stato causato da una grave negligenza o da un comportamento doloso da parte di www.michaelmortini.com.

www.michaelmortini.com è espressamente esonerato dalla responsabilità per danni derivanti direttamente o indirettamente per l’Utente o per terzi sulla base delle informazioni fornite dall’Utente. L’Utente è responsabile dell’esattezza, anche tecnica, delle proprie informazioni. Inoltre www.michaelmortini.com non si assume alcuna responsabilità in relazione all’esecuzione di ordini su piattaforme e/o borse di terzi.

www.michaelmortini.com sottolinea espressamente che non si assume alcuna responsabilità per l’elaborazione delle transazioni basate sui software automatici. Ciò vale in particolare per i danni causati da interruzioni o altri guasti sistemici nonché da particolarità di terzi (ad es. tempi di inattività dei server, interruzione di Internet, mancata disponibilità di API, errori di programmazione e/o di sistema da parte di un broker di trading).

L’Utente è consapevole che www.michaelmortini.com non ha alcuna influenza sul collocamento e/o sull’esecuzione delle transazioni con terze parti. www.michaelmortini.com non fornisce alcuna garanzia o dichiarazione riguardo ai tempi, alle dimensioni o al volume delle transazioni basate sui software automatici. Si esclude anche la responsabilità per eventuale ritardi nelle transazioni o in relazione a transazioni che non sono state completate nella forma desiderata.

Nessuna sponsorizzazione né referral condiviso costituisce un consiglio ad utilizzare o meno quella specifica piattaforma.

11 Collegamenti

I riferimenti diretti o indiretti offerti sulla piattaforma a contenuti esterni (ad esempio link esterni, banner o altre informazioni e offerte pubblicitarie) sono forniti nell’interesse dell’Utente, a seconda dei casi. I contenuti offerti non sono concepiti, modificati o valutati in altro modo da www.michaelmortini.com. Questa piattaforma non ha alcuna influenza su questi contenuti; l’accesso ad essi è di esclusiva responsabilità dell’Utente. Non è possibile monitorare costantemente il contenuto delle piattaforme collegate.

12 Legge applicabile e giurisdizione

Le presenti CG così come tutti gli accordi presi tra le parti sono soggetti alla legge italiana.

Nel caso dei consumatori, questa opzione si applica solo nella misura in cui la protezione garantita dalle disposizioni inderogabili della legge del paese di residenza del Consumatore non sia in tal modo compromessa.

Il tribunale competente in Italia sito in Treviso, ha competenza esclusiva per tutte le controversie derivanti dal rapporto contrattuale. Ciò non pregiudica il diritto dell’Utente di agire in giudizio in qualsiasi altro foro inderogabile. Per tutte le azioni intentate da www.michaelmortini.com contro un Utente che deve essere qualificato come Consumatore e che ha il suo domicilio, la sua residenza abituale o la sua sede di lavoro in Italia per controversie derivanti dal rapporto contrattuale, sarà competente uno dei tribunali nel cui distretto il Consumatore ha il suo domicilio, la sua residenza abituale o la sua sede di lavoro. Per gli utenti che non hanno la residenza in Italia al momento della conclusione del contratto, si applicano i luoghi legali di competenza.

1 Scope / amendment of the General Terms and Conditions

The following General Terms and Conditions (“GTC”) shall apply to all present  and future business transactions, contracts and business relationships, in any case and in particular also to transactions with/on online, on https://www.michaelmortini.com.

These General Terms and Conditions apply both to consumers and to entrepreneurs within the meaning of the Italian Consumer Code (Dlgs. 06/09/2005, n. 206).

Under Italian law, a consumer is defined as any natural person who is acting for purposes which are outside his or her trade, business, craft  or profession.

By creating  the appropriate account  on the website, the User accepts these GTC and declares his agreement with the content. The GTC can be retrieved, downloaded, printed and stored on the respective storage of the User.

This platform expressly rejects any deviating general terms and conditions of the User. Deviating or supplementary general terms and conditions of the User shall not become part of any contract, even if they have not been expressly rejected.

The provisions of these GTC may be amended by www.michaelmortini.com at any time without giving reasons. The User must verify amendments made in the GTC before  the log in on the platform.

The User agree to the to the amended GTC by the “log in” on the platform.

2 Conclusion of a contract

M. Mortini is the creator of the services, software and tools licensed on this site. Every limitation of liability provided from these GTC are extended to M. Mortini.

www.michaelmortini.com  only offers products and access to the platform to those persons who are of legal age. The User declares to be at least 18 years old.

3 Registration / Login Data

In order to be able to use the Services provided by www.michaelmortini.com, the User undertakes to register on the platform by providing valid and truthful information, in accordance with the registration form. The User will only be able to make use of the services provided on the platform once registration has been successfully completed.

This platform is entitled to reject Users at its own discretion without giving reasons and to change any of the criteria for the registration at any time before concluding a transaction.

4 Disclaimer: limitation of liability

This platform offers the User the possibility to purchase a trading robot and disseminates information for educational purposes only. It is NOT to be intended in any way as investment operating advice nor as a solicitation for the collection of public savings.

Trading robots are programs in the terminal that have been developed to work in the “Metatrader 4” platform, and used for automation of analytical and trading processes. They allow to perform prompt analysis of price data and manage trading activities on basis of signals received. They help traders to determine whether to buy or sell currency pairs or other trading assets in CFD at a given point in time for Live Trading.

The User understands and expressly acknowledges the risks related to Live Trading.

michelmortini.com and its services, or trading tools are NOT to be intended as financial or investment advices in any way.

The User is solely responsible to provide for the respective settings and/or verification levels necessary or useful to operate the bot with the exchange. Further, this platform does not assume any liability for any internet connections with the exchange, in particular, but not limited to, in respect of any bandwidth, ping time, or any other details of any internet connection.

The software is provided by the Vendor and accepted by the Licensee “as is”. Liability of the Vendor will be limited to a maximum of the original purchase price of the software. The Vendor will not be liable for any general, special, incidental or consequential damages including, but not limited to, loss of production, loss of profits, loss of revenue, loss of data, or any other business or economic disadvantage suffered by the Licensee arising out of the use or failure to use the software.

The Vendor does not warrant that use of the software will be uninterrupted or error-free. The Licensee accepts that software in general is prone to bugs and flaws within an acceptable level as determined in the industry. The Vendor may suspend the operation of licenses, in whole or in part even without prior notice, in the event of network and equipment failures that depend on force majeure, or events beyond the control of michaelmortini.com.

If you are a consumer, please note that in some jurisdictions consumer protection laws may not allow certain exclusions or limitations of warranties or liability, and as a result some of the above exclusions and limitations may not apply to you.

5 Licensing – copyright – express termination clause

This platform according with the bot creator agrees to grant the User a non-exclusive license to use the software available on the platform. This website reserves the right to exclude the User if this one has breached one of his obligations under this GTC or if the User has breached any law in connection with the function of the bot.

“software” includes the executable computer program and any related printed, electronic and online documentation and any other files that may accompany the product.

Title, copyright, intellectual property rights and distribution rights of the software remain exclusively with the Vendor. Intellectual property rights include the look and feel of the software. This Agreement constitutes a license for use only and is not in any way a transfer of ownership rights to the software.

The software may not be loaded or used in a trading account other than the one associated with the software license at the time of purchase. The strategy of the software cannot be replicated on trading accounts for which a specific license was not purchased.

The rights and obligations of this Agreement are personal rights granted to the Licensee only. The Licensee may not transfer or assign any of the rights or obligations granted under this Agreement to any other person or legal entity. The Licensee may not make the software available for use by one or more third parties unless expressly stated, requested and agreed upon at the time of purchase on this platform. In such case, the User purchasing the license shall assume any liability towards third party beneficiaries.

The software may not be modified, reverse-engineered, or de-compiled in any manner through current or future available technologies.

The operation of the license is contingent on this platform remaining in place.

Failure to comply with any of these terms under the License section constitutes an express termination of this Agreement.

6 Termination and Refund of Payments

If www.michaelmortini.com terminates the license because of an infringement committed by the User there will not be any refund.

7 Right of withdrawal

Pursuant to Art. 52 of the Italian Consumer Code, the Right of Withdrawal applies to any purchase of digital software which requires a download and which has not been used.

Upon purchase, you acknowledge your Right of Withdrawal is waived when you download the digital software or receive it in any form or way.

To exercise their right of withdrawal, within 14 days of the purchase, User must send to the platform an unequivocal statement of his intention to withdraw from the contract.

To this purpose, Users may use the following model withdrawal form:

I/we hereby give notice that I/we (*) withdraw from my/our contract of sale of the following goods (*)

  • Product
  • Ordered on data
  • Name of consumer(s)
  • Address of consumer(s)
  • Signature of consumer(s) (only if notice is sent on paper)
  • Date

User is however, free to express his intention to withdraw from the contract by making an unequivocal statement in any other suitable way (e.g. a letter sent by post).

In order to meet the deadline within which the User can exercise such right, User must send the withdrawal notice before the withdrawal period expires.

User who correctly withdraw from a contract will be refund by the platform for all payments made to www.michaelmortini.com.

8 Obligations of the User to cooperate

The User undertakes to do everything in his power to ensure the rapid performance of the contract and to refrain from doing anything that could thwart or jeopardize the performance of the contract. The User shall immediately notify www.michaelmortini.com of any defects or other problems in connection with the purchased product.

9 Risks

The User understands and accepts the risks listed below in connection with the use of the platform and the software provided with it. These include in particular the following risks:

  1. Software risk: The software licensed by www.michaelmortini.com is still under development and is subject to constant change. It cannot be ruled out that the software is not yet fully developed and contains weak points or errors that may restrict the trading based on the Bots.
  2. Regulations: Insofar, the software licensed by www.michaelmortini.com have not been subject to any significant regulatory restrictions.  However, we can’t exclude that the licensed software in a future could be subject to restriction imposed by law. In this case this platform won’t have any responsability due the impact of new regulamentation.
  3. Internet dangers and loss:  www.michaelmortini.com can become the target of physical or electronic attacks. This could lead to the loss of data (such as personal data or other data provided or created by the User). Data could also be taken away unlawfully and used for abusive or fraudulent purposes (such as phishing or spoofing). The User will carefully check messages and communications from www.michaelmortini.com and check whether the messages or communications originate from www.michaelmortini.com.
  4. No guarantee of success: The use of the software licensed by  www.michaelmortini.com is no guarantee that the User will derive economic success from it. The software licensed by www.michaelmortini.com merely offers the User the possibility of setting a bot. Therefore www.michaelmortini.com expressly informs the User, that there is a certain risk that flawless execution of transactions at certain prices and quantities may occur. www.michaelmortini.com does NOT offer financial or investment services in any way. Therefore, disseminated information and the software should not be understood in any way as an investment operating advice, nor as a solicitation to raise public savings or asset management. The software in question is an operating tool intended exclusively for the “Metatrader 4” trading platform to assist the User in trading on the markets. The User can enable and disable the functions of the software at any time, setting each parameter according to his own strategy and maintaining constant control over the trading activities carried out: the User can in fact authorize or inhibit the opening of new trades and close in any time the open trades, maintaining constant control of his Trading Account and the final word on all decisions. It has to be intended as a tool that through certain algorithms allows the User to develop specific trading strategies; the User always remains in full control of his trading account, independently deciding the assets to trade with, the strategy to be used, the methods of entry and exit from the market, and everything related to the money management and the risk/reward profile. The User assumes full and total responsibility for their choices and operational strategies applied through the software. The User is fully aware of the economic risks associated with any form of use of the software and in general he is aware that operating with real money in the trading sector involves very high risks of losing the invested. By manually enabling the software, the User accepts that it automates certain operating processes on his behalf, totally relieving michaelmortini.com from any liability relating to damage or loss suffered. michaelmortini.com, as manufacturer and distributor of the software, expressly disclaims, for itself and for its collaborators, any liability arising from the use of his services, for any loss or damage suffered by the User. It is the User’s obligation to set, control and constantly monitor the work of the software. The User has to use trading strategies compatible with his objectives and with his risk appetite: the algorithms implemented in the software do not and cannot provide any guarantee regarding future and unpredictable events, such as market trends or macroeconomic news. Safeguarding the invested capital depends solely on the choices made by the User, especially with regard to the size of the trades opened and the money management. The different strategies shown in the User manual represent only a partial examination for educational purposes of the possible ways of using the software and cannot in any way be considered as financial or investment advice. The consulting activity provided by michaelmortini.com and its collaborators is limited to technical issues, such as the installation and use of the various functions of the software: it cannot be considered as a financial consultancy activity, which is legally delegated to qualified financial advisors. The showed results related to the use of the software (tests, histories and results reported on the website michaelmortini.com and also provided with other means) do not constitute any guarantee of hypothetical and similar future profit performance. Similarly, the settings used in achieving the aforementioned results are not intended as investment advice, but only as parameters that have proven to be profitable in the context of tests carried out on historical data: there is no guarantee from michaelmortini.com on the fact that the same settings can be effective and profitable in the future, or can in some way protect the account from partial or total losses. This website and the use of the software are not aimed neither at societies nor at retail investors belonging to jurisdictions in which, by virtue of nationality, type of person, residence or any other reason, the access to the site, its consultation and the use of the services offered should be prohibited or subject to restrictions. The persons to whom such restrictions apply are to be consequently considered not allowed to access our services. The User is aware that the value of currencies or CFD assets is subject to a general market risk and thus to fluctuations in value and price; www.michaelmortini.com has no influence on the values and prices of traded currencies or other goods or assets. 
  6. Taxes: The use of the bot and especially the resulting transactions can have tax effects at the level of the customer in according with the User’s local law. The User expressly declares that he/she will clarify any tax effects and obtain appropriate advice (e.g. from a tax advisor). The User also expressly declares that he/she will not hold www.michaelmortini.com or any party associated therewith (in particular consultants, employees and other contractual partners) liable for tax obligations.

10 Liability

The administration of the platform is carried out by www.michaelmortini.com with the necessary due care. The User is aware that interruptions, failures or other errors and problems may occur in both of the software (i.e software bugs) and the hardware of internet-based and experimental technology services. www.michaelmortini.com will try to find solutions to such problems as far as possible. In any case, www.michaelmortini.com does not assume any obligations and in particular any liability for damages that may result or occur from interruptions, failures or other errors and problems of or in connection with the platform and the services offered and/or the software, in particular in case of not intended trades or false trades, which may lead to a financial and/or other damage of any User.

To the extent permitted by law, www.michaelmortini.com shall only be liable on whatever legal grounds if damage was caused by gross negligence or willful misconduct by www.michaelmortini.com.

www.michaelmortini.com liability for damages arising directly or indirectly for the User or for third parties on the basis of the information provided by the User is expressly excluded. The User is responsible for the accuracy, including technical accuracy, of his own information. Further www.michaelmortini.com does not assume any liability in connection with the implementation of orders at any third-party platform and/or exchange.

www.michaelmortini.com expressly points out that no liability is assumed for the processing of transactions based on the automated software. This applies in particular to damage caused by interruptions or other systemic failures as well as special features of third parties (e.g. server downtime, internet outage, non-availability of APIs, programming and/or system errors on the part of a trading Broker).

The User is aware that www.michaelmortini.com has no influence on the placement and/or execution of transactions with third parties. www.michaelmortini.com makes no warranties or representations regarding the timelines, size or volume of transactions based on automated software. Liability is also excluded for any delayed transactions or transactions that have not been completed in the desired form.

Shared referral links should not be understood in any way as an advice to operate or not with that specific platform/service.

The direct or indirect references offered on the platform to external content (e.g. external links, banners or other information and advertising offers) are provided in the interest of the User, as the case may be. The content offered is not designed, edited or otherwise evaluated by www.michaelmortini.com. This platform has no influence on these contents; access to them is the sole responsibility of the User. It is not possible to monitor the content of linked platforms on an ongoing basis.

12 Applicable law and jurisdiction

These GTC as well as all agreements made between the Parties are subject to Italian law.

In the case of consumers, this choice of law shall only apply insofar as the protection granted by the mandatory provisions of the law of the country of the consumer’s residence is thereby not jeopardized.

The competent court in Italy, in Treviso, is  exclusively responsible for all claims arising from disputes arising from the contractual relationship. This shall not affect the right of the User to sue at any other mandatory legal venue. For all actions brought by www.michaelmortini.com against a User who is to be qualified as a consumer and who has his domicile, habitual residence or place of employment in Italy due to disputes arising from the contractual relationship, one of the courts in whose district the consumer has his domicile, habitual residence or place of employment shall have jurisdiction. For Users who do not have a residence in Italy at the time of the conclusion of the contract, the legal places of jurisdiction shall apply.

  • User acknowledges that has read and understood the above agreement in its entirety and agrees to abide by it.
